Introduction

Welcome to Bota, a product operated by GalaxySailLab Inc. (“Company”, “we”, “our”, or “us”).

These Terms of Service (“Terms”) govern your use of our website located at https://bota.dev and any related hardware, software, APIs, and services (collectively, the “Service”).

Our Privacy Policy also governs your use of the Service and explains how we collect, safeguard, and disclose information resulting from your use. By accessing or using the Service, you agree to these Terms and our Privacy Policy (together, the “Agreement”).

These Terms apply to all visitors, users, customers, and others who access or use the Service.

Communications

By creating an account or submitting your contact information, you agree to receive service-related communications from us, including account notifications, technical updates, billing notices, and administrative messages.

You may opt out of non-essential marketing communications by following the unsubscribe instructions included in those communications.

Purchases

If you purchase any hardware, subscription, or services through Bota (“Purchase”), you may be required to provide payment information, billing address, and shipping details.

You represent and warrant that:

You have the legal right to use the payment method provided; and
The information you provide is accurate, current, and complete.

We may use third-party payment processors to facilitate transactions. By submitting payment information, you authorize us to share necessary information with those providers in accordance with our Privacy Policy.

We reserve the right to refuse or cancel orders at our discretion, including in cases of pricing errors, suspected fraud, or product unavailability.

Subscriptions

Certain parts of the Service are offered on a subscription basis (“Subscriptions”).

Subscriptions are billed in advance on a recurring basis (“Billing Cycle”), which may be monthly, annual, or as otherwise agreed in writing.

Subscriptions automatically renew unless:

You cancel prior to renewal; or
GalaxySailLab Inc. terminates the Subscription.

You authorize us to charge applicable Subscription fees to your designated payment method.

If payment fails, we may suspend or terminate access until payment is resolved.

Hardware Use

If you purchase or deploy Bota hardware devices:

You are responsible for ensuring lawful use of recording devices in your jurisdiction.
You must obtain all legally required consents before recording meetings.
You are responsible for proper installation, maintenance, and secure use of devices.

GalaxySailLab Inc. is not responsible for unlawful or unauthorized use of recording equipment.

Hardware may be subject to additional warranty or purchase terms provided at the time of sale.

API Usage

Bota provides APIs that allow customers to access recordings, metadata, and related services.

You agree not to:

Abuse or excessively load the API infrastructure
Reverse engineer non-public components
Attempt unauthorized access to other customers’ data
Circumvent rate limits or security controls

We may suspend or revoke API access if misuse is detected.

Fee Changes

We may modify Subscription fees at our discretion. We will provide reasonable notice before changes take effect. Continued use of the Service after a fee change becomes effective constitutes acceptance of the updated fees.

Refunds

Except where required by law, Subscription fees are non-refundable.

Hardware purchases may be subject to separate return policies disclosed at the time of purchase.

Prohibited Uses

You agree not to use the Service:

In violation of any applicable law or regulation
To record individuals without legally required consent
To exploit or harm minors
To interfere with Service functionality
To attempt unauthorized system access

You further agree not to introduce malicious code, conduct denial-of-service attacks, scrape non-public content, or misuse APIs.

Analytics

We may use third-party analytics providers to monitor and analyze use of our website and Service.

No Use by Minors

The Service is intended only for individuals at least eighteen (18) years old. By using the Service, you represent that you meet this requirement.

Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

We reserve the right to suspend or terminate accounts at our discretion.

Intellectual Property

The Service, including hardware designs, software, APIs, trademarks, and content (excluding customer data), is the exclusive property of GalaxySailLab Inc. and its licensors.

You may not copy, modify, distribute, or create derivative works without prior written consent.

Customer Data

You retain ownership of recordings and data processed through the Service.

GalaxySailLab Inc. processes data solely to provide the Service and in accordance with customer instructions and applicable agreements.

You are responsible for ensuring lawful collection and recording practices.

Disclaimer of Warranty

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

GALAXYSAILLAB INC. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GALAXYSAILLAB INC. SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Termination

We may suspend or terminate access to the Service for violation of these Terms.

Provisions relating to intellectual property, disclaimers, limitation of liability, and governing law survive termination.

Governing Law

These Terms are governed by the laws of the State of California.

Any disputes shall be resolved in the state or federal courts located in California.

Amendments to Terms

We may update these Terms at any time by posting a revised version on our website. Continued use of the Service constitutes acceptance of the updated Terms.
